CFA UK Ethics Case Study Competition terms and conditions
The promoter is the CFA Society of the UK (CFA UK), a company limited by guarantee, incorporated in England and Wales under company number 04035569 and whose registered office address is at 4th Floor Minster House, 42 Mincing Lane, London, England EC3R 7AE
2.1The title of the competition is CFA UK Ethics Case Study Competition 2018/19.
2.2The competition will run from November 2018 (the “Opening Date”) to 17:00 on 31 August 2019 (the “Closing Date”) inclusive. All competition entries received on or after 17:00 on (the "Closing Date") are automatically disqualified.
2.3To enter the competition download a copy of the entry form from our competition webpage and send the completed form by email to firstname.lastname@example.org by the closing date.
2.4You must ensure that the competition entry: (a)does not disclose any confidential information (directly or indirectly); (b)if the competition entry is based on a real-life case, does not include any details that (directly or indirectly) may identify any persons, organisations or other stakeholders involve in the original case; (c)does not contain any material which is defamatory or libellous of any person or organisation; (d)does not contain any material which is obscene, offensive, hateful, inflammatory or otherwise unlawful; (e)does not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; (f)is not subject to any restrictions that may prevent or restrict the Promoter from using your competition entry or publishing your competition entry in accordance with paragraph 7.2; (g)does not infringe any copyright, database right, trade mark and/or other intellectual property rights of any person or organisation.
2.5No purchase is necessary and there is no charge to enter the competition.
2.6The Promoter will not accept responsibility for competition entries that are not received by the Closing Date, delayed or lost in transit, regardless of cause.
2.7By submitting a competition entry, you are agreeing to be bound by these terms and conditions. If you do not agree to these terms and conditions please do not enter the competition.
2.8The competition entries will be judged by a panel of judges selected by the Chief Executive of the CFA UK, and the CFA UK Ethics Committee (a volunteer committee which supports, and is primarily made up of, members of the CFA UK). All competition entries will be judged on an anonymous basis.The decision of the CFA UK Ethics Committee will be final.
3.1The competition is open to all members of CFA UK or CFA Institute, except: (a)employees of the Promoter or members of the CFA UK Ethics Committee; (b)employees of agents or suppliers of the Promoter, who are professionally connected with the competition or its administration; or (c)members of the immediate families or households of paragraph (a) and (b) above.
3.2In entering the competition, you confirm that you are eligible to do so and are eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.
3.3Joint submissions are allowed, provided each individual entrant is eligible.
3.4The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
3.5Competition entries cannot be returned.
4.1Each winning entry of the competition will receive:
(a)a £500 cash prize or if you choose to do so, the Promoter will donate the £500 cash prize to a charity of your choice on your behalf; and
(b)an invitation to the CFA Society’s Annual Dinner in October 2019.
4.2The prizes detailed at paragraph 4.1 will be awarded to up to two winning entries (subject to clause 4.5) based on word count of submission – one winning entry will be for fewer than 500 words, the second winning entry will be for entries over 500 words. There is no minimum or maximum word count.
4.3In the event that a winning entry is a joint submission from multiple individuals, the total prize money for that entry as detailed at paragraph 4.1 shall be divided equally amongst the individuals who entered the submission (each such entrant a “Joint Winner”). CFA UK may in its absolute discretion provide additional invitations to enable more than one Joint Winner to attend the CFA Society’s Annual Dinner.
4.4The Promoter reserves the right to withdraw the competition at any time before or after the Closing Date in the event that it determines in its absolute discretion that it has not received sufficient or sufficiently high quality entries by the Closing Date.
4.5The prize is not negotiable or transferable. The prize may not be claimed by a third party on your behalf. The Promoter does not accept any responsibility if you are not able to take up the prize for any reason.
5.1The winner of the competition will be announced by press release on the Promoter’s website and / or an email newsletter from the Promoter by early October 2019 (Announcement Date).
5.2The decision of the Promoter is final and no correspondence or discussion will be entered into.
5.3The Promoter will contact the winner personally by email and/or by telephone as soon as practicable after the Announcement Date, using the email address and/or telephone number provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted. If the winner, once contacted by email, fails to respond within a period of 15 days following the date on which the email is sent notifying it of the prize the prize shall be relinquished and the Promoter hereby reserves the right to offer the prize to the next eligible winner (if any) selected from the entries that were received before the Closing Date.
5.4The Promoter will send the name of the winner to anyone who writes within one month after the Closing Date of the competition requesting details of the winner and who encloses a self-addressed envelope to the address set out in clause 1 and the name of the winner will be available on request at the offices of the Promoter set out in clause 1 for a period of 30 days.
LIMITATION OF LIABILITY
6.1Nothing in these terms and conditions will limit the Promoter’s liability for death or personal injury caused by its negligence or for fraud.
6.2Insofar as is permitted by law, the Promoter (including without limitation the CFA UK Ethics Committee), its suppliers or agents will not in any circumstances be responsible or liable to compensate you or accept any liability for any loss, damage, personal injury or death occurring as a result of your entry to the competition, including any use of your entry by the Promoter, its suppliers or agents, except where it is caused by the negligence of the Promoter, its agents or suppliers or that of their employees. Your statutory rights are not affected.
OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
7.1All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
7.2You agree that the Promoter may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition, for all of the CFA UK’s business purposes and for the advancing education for the benefit of members of the CFA UK. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
DATA PROTECTION AND PUBLICITY
8.1By entering the competition, you agree that unless you elect not to have your name associated with a case study, the Promoter and its suppliers may use your name, town of residence, image and any social media profile to announce the winner of this competition (if you are the winner), in the event that the Promoter uses your entry in accordance with paragraph 7.2 and for any reasonable or related promotional purposes.
8.2By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition and in order to use your competition entry in accordance with paragraph 7.2.
9.1If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion,reserve the right to exclude you from participating in the competition.
9.2The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
9.3These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
